Administrative fine for nuisance
General
Submit an objection if you do not agree with a fine given for nuisance in a public area. You must submit the appeal within 6 weeks from the date (date of issue) of the fine.
What can you object to?
Fines issued for situations in public spaces concern:
- Letting a dog run loose where it is not allowed.
- Improperly disposing of rubbish.
- Urinating in public.
For these forms of public nuisance, you can receive an administrative fine. If you disagree with the fine, you can submit an objection here.
Good to know
Do you want to request the photo of the offence or have you already done so? First, review the photo to decide whether you want to submit an objection.
Is it a parking fine? Then go to the page about Submitting an objection to a parking fine.
If you submit an objection, you do not need to pay the fine immediately. You will receive an acknowledgment of receipt by post within a maximum of 2 weeks. You will be granted a payment extension once you have received this written acknowledgment of your objection. If your objection is rejected, you must pay the fine within 2 weeks after receiving the decision.
You can file an appeal digitally. Please note, the form is in Dutch.
Is an objection likely to succeed?
If you file an objection, you must explain the reasons for your objection. However, some reasons will not succeed in overturning the administrative fine:

-
This is not a valid reason for a justified objection unless you can prove it. You must provide evidence that you placed the waste in the container or wheelie bin and secured it properly.
-
This is not a valid reason for a justified objection. As a resident, it is your responsibility to know the waste disposal rules. You can find them at breda.nl/en/waste.
-
This is not a valid reason for a justified objection. The fine specifies the time the violation was observed or recorded. This does not necessarily correspond to the time the offence was committed.
